The agreement
These terms are an agreement between you and Klemento Ltd, a company registered in England and Wales (referred to here as Klemento, we, or us). They cover your use of klemento.com, app.klemento.com, and the Klemento API.
By creating an account or using the service, you agree to these terms. If you don't agree, please don't use the service.
Who can use Klemento
You need to be 16 or older. If you're using Klemento on behalf of a company, you confirm that you have the authority to bind that company to these terms.
We can refuse service or close accounts at our discretion if you breach these terms or use Klemento in a way that risks harm to other users, our infrastructure, or our reputation.
Your account
You're responsible for keeping your sign-in credentials secure and for any activity under your account. If you think your account has been compromised, sign out of all sessions from your settings page and email [email protected].
One person, one account. You can use Klemento on as many devices as you like, but please don't share login credentials with other people.
Subscriptions and refunds
The free tier gives you a limited number of analyses per month. Paid plans (Pro, Team) unlock additional features and are billed monthly or annually by Lemon Squeezy. All prices on klemento.com are in GBP and exclude applicable VAT, which is added at checkout based on your billing country.
Subscriptions renew automatically until cancelled. You can cancel at any time from your settings; access continues until the end of your current billing period.
If you're unhappy with a paid plan within 14 days of your first payment, email us for a full refund. After that, refunds are at our discretion. We don't pro-rate mid-period cancellations because the cost difference is negligible and the admin overhead isn't.
Your content
Anything you submit to Klemento (transcripts, settings, analyses) is your content. We don't claim ownership.
To run the service, you grant us a limited, worldwide, royalty-free licence to process your transcript text in order to produce coaching, store the structured coaching output in your account, and display it to you. That licence ends when you delete the analysis or close your account.
We do not use your content to train AI models. We do not share your content with anyone other than the subprocessors listed in our privacy policy, each of which has signed a data processing agreement.
Acceptable use
Don't use Klemento to:
- Submit content that's illegal, infringing, defamatory, or fraudulent.
- Submit content from people who haven't consented to being recorded or transcribed (this is your responsibility under local law, not ours).
- Attempt to extract, reverse-engineer, or otherwise tamper with the service.
- Run automated scanners, scrapers, or load tests against production.
- Resell access to the service without our written permission.
We can suspend or close accounts that breach these rules without notice.
Disclaimers
Klemento provides AI-generated coaching feedback. It is input to your judgement, not a substitute for it. The model can be wrong, miss context, or surface advice that doesn't fit your situation. Don't treat the output as professional advice (legal, medical, financial, psychological) and don't use it as the sole basis for any high-stakes decision (hiring, firing, performance reviews).
The service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We don't guarantee uninterrupted availability or error-free operation.
Limitation of liability
To the maximum extent permitted by law, neither Klemento nor anyone connected to it is liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service. Our total aggregate liability for direct damages is capped at the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) £100.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under English law (such as liability for fraud, death, or personal injury caused by negligence).
Termination
You can close your account at any time from your settings. We can close your account if you breach these terms, with notice where reasonable.
On termination, your structured analyses are deleted within 30 days, subject to backups which are purged on a 30-day cycle. The provisions of these terms that should reasonably survive termination (intellectual property, disclaimers, limitation of liability, governing law) continue to apply.
Changes to these terms
We may update these terms occasionally. If we make material changes, we'll email everyone with an active account at least 14 days before the changes take effect. Smaller wording changes are reflected in the "last updated" date at the top of this page.
Continued use of the service after changes take effect counts as acceptance.
Governing law
These terms are governed by the laws of England and Wales. Any dispute arising out of or related to them will be resolved exclusively in the courts of England and Wales, except where local consumer-protection law grants you a right to bring proceedings in your country of residence.
